    Default Are The Council Correct?

    Hi,

    The empty block of land that is on the other side of the road to us (opposite) as become overgrown with wild bushes and as in recent months become a dumping ground for the tenants in adjoining blocks of apartments, flats & units.

    I contacted the local council (via email) yesterday and got a reply today saying that given that the block of land is privately owned it is not their responsiblity to remove the rubbish nor cut and remove the bushes.

    I had been informed from a friend though that the owners do have a duty to place temporary fencing along any access areas - is this true? I live in Melbourne. Other than the start of the summer season, can the owners be pushed into keeping their grass and bush areas to a certain standard?

    Metal Head,

    No it's not the councils' problem unless....the Heath Deparment becomes involved.


    In NSW if the area poses a heath risk (vermin infested) then the council is bound to take action and they will bill the owner.


    So my advice is to go to the Health Department (I think most councils have a Health officer you can talk to).

    Thanks for the quick reply "The Bleeder".

    I just had a reply from the council stating that if the block of land was due to be built on shortly then temporary fencing is required.

    Btw, I did ask the council if they could tell me who the owner(s) was (so I could go and pay him a surprise visit and drop the s7%t on their doorstep) but they refused on privacy issues.

    Which leads me to ask where can I obtain this information from, or does it have to be done via a legal representative?

    Default look at fence laws

    You could ask the neighbour of this block to ask the council for the address of the owner saying that you want to replace the fence. This way you may get the address and send a polite letter asking for it to be cleaned up. Just a thought

    My council gave my name to some idiots who wanted to help me out by cutting up some logs I had carted to the block into firewood for themselves.

    the lands department can give you the information you require.

    who owns what is public record and it is easily accessible.

    the owners are required to keep the block in a reasonable condition.

    the owner may be able to force the adjoining property's to clean up the entire block as they have been dumping on it.

    I would report it as a fire hazard come spring. The council can then order it slashed using a fire abatement notice.
