Multiple phone calls like most however I must have got them at the right moment. He actually transferred the money in two goes as well while I waited on the phone.
There is a saying in sales that the next person to speak loses. Long gaps of silence when you are not happy can work as the other person thinks they need to say something or do something.
Any communication should now be return of money, nothing else. Advise calmly that you know all his details from his business registration and will not stop to get your money back.
I would also arrange your own courier to collect the item. I was told that mine was 'just' put on the courier truck however the courier company specified didnt deliver to the sth island......
Good luck!
Good luck.

I had a mate drop by the Williamstown location today to try and pick up a compliance plate/vin for me today but the place was shut up. Also despite about 100 attemps I couldnt get our mate Scott to answer today. Yesterday he answered the phone to me and sent me a VIN number but it had too many characters and was useless. Anyone know what is going on with Scott/ the shop at the moment?

My guess is they have done a runner!
You must all get together now and pursue some action.
All those who were holding back, not wanting to rock the boat, in the hope their camper might arrive, should get on to the media now to track down where they are and pressure them for answers for rectifying their problem.

He also was trading under another name on Ebay, and last night he cancelled all his bids. The reason that was listed was "trailer not available anymore".
Hopefully he has come to the realisation that you cant rip people off and get away with it..
I dont believe anything that he says until I either see it with my own eyes or it is confirmed.

To everyone thats been on this forum, please read what i have to say:
My husband & I have just driven 2600kms to Williamstown and back. We left on Sunday morning and got back today at 3pm. absolutely stuffed, and mentally and physically DRAINED.
Scott wasnt aware of our plan and thankfully ACA had rang me just prior to getting into Melb.
WE approached Scott with full camera crew on board right behind us.
Scott #### himself and hid inside and wouldnt show his face so we followed him inside the workshop to GIVE IT TO HIM.
We questioned a cheque he had deposited into our bank on Thurs 31st Dec. We knew it was going to bounce and he did too and told us it would.
We'll he didnt lie about that because on Tues 5th Dec it bounced.
Said he would have some cash for us by 5pm yesterday but we werent holding our breath.
We did our interview with ACA on Monday afternoon of which I can now tell them to air it. Scott didnt want us to do this if he gave us back our money.
Well as we havnt got our money expect this to happen. I hope Scott is reading this :)
Prior to leaving Melb, we put it into the hands of the lawyers.
We dont consider our trip to Melb as wasted as it was far from it. Now we have complete satisfaction that this person has finally been EXPOSED. Someone had to take the lead in this and we feel that is what we have done.
To everyone out their in the same or similiar situation, GOOD LUCK !
Whether he keeps trading or goes bankrupt or WHATEVER, at the end of the day, we have no trailer and no $8790.00.
PS. Scott if u are reading this and i know doubt u are....KISS MY A.__E !! Im not out of your life ....YET - SORRY IF U THOUGHT I WOULD BE :)

Well we gave Scott till the end of today to pay us the rest of the money that he owed us. He said that he will call us back at 3.00 this arvo..Well Well Well.. NO CALL.
I have no sympathy for both of these men Scott & Rob as they have both lied to me and as far as I am concerned, deserve everything they get.. I have given them both chances to clear this matter up. I feel as though I have wasted the last 5 months of my life on this trailer Saga and hope they both go down for what they have done to all people out there..
I advise everyone to get on to A Current Affair and dont wait as the reality is there is going to be nothing for anyone for awhile. He is worth nothing and has no assets.
A Current Affair is filming stories now so Contact Nicole on 03 94203281

Yeah, I also paid in full for a trailer back in late November 2009 and am yet to receive it. I was promised it before Christmas, but it hadn't arrived. I went to the factory expecting to find an empty shell, but there were four guys in there working their guts out on 6 trailers. I spoke with Scott face to face and was assured it would still be coming. Not sure what has happened today, but he can no longer get into the factory to work?
I have three small children and would like to think I'd not been duped out of our savings, but I think this company got very big very quick due to the internet, and is just still catching up.
And yes, a real lack in communication doesn't help things. But should Scott declare himself bankrupt due to everyone wanting a cash refund, I'm certainly not going to be happy with 10 cents in the dollar.
You can't squeeze blood from a stone...Something to think about?
My apologies if I've offended anyone

You havent offended me and I understand were you are coming from. But when you have been lied to like a lot of people for the last 5 months, when do you call it enough.
From what I have heard he has at LEAST 25 trailers still outstanding and probably more, and I cannot see the light on how he is going to pull himself out of this ditch unless he rips off more innocent people.
I dont want to see people walk away with nothing and hope to see everyone either recieve there trailers or a refund, but Scott needs to stop hiding and step up to the plate, I would not believe a word that come out of his Full of s**t mouth until things start happening and alot hasnt been hapening over the last few months apart from lies and more lies..
I hope that you eventually reicieve your trailer and the other people get what they want also, it is just a very frustrating and emotional time for everybody..
Thanks for posting..

Not sure why he wouldnt be able to get to the factory to work??:?
Maybe he doesnt want to be faced by several angry people waiting for him.
All they want is answers to where there money has gone??????
He needs to step up to the plate as I said before and stop hiding...and start dealing with the situation that he has created..

Hey Maddy,
sorry didnt ring you we have been travelling for the last few days. I believe that you met my husband (the one with the loud shorts) and his mate at the factory during your visit. They both waited several hours at the site for the slimy little squid however he did not turn up.............seems he is hiding.
I hope you are reading this you slimy little boy ( not worthy of being called a man) because we to have contact ACA, Fair Trading and our solicitors.
I dont care if it costs more than the damn trailer (which by the way info gathered by my hubby from others ripped off it probably lucky we didnt get the trailer) the point is that while we may not be rich we worked our damn asses off to get the money for the trailer and we want it back.

dont waist time on phone calls you will only get lies and a big phone bill get legal adviceI have been following this thread with interest and feel sorry for all of you who are out of pocket in this matter. I can understand your frustrationn and anger and I sympathise with you. Unfortunately, in reality, this is a no win situation. You may get some satisfaction by legal proceedings but bare in mind, the cost of such action is very high and a drawn out process and whether the cost and effort involved in taking such action is justified in the end is not clear cut by any means.
If this is a case for fraud or whatever, chances are you are not going to get your money back or your trailers.
Unfortunately some trade practices are unethical but quite legal in the real sense of the word. I really hope you all come out as winners in this situation but I would think long and hard before venturing on a costly and long drawn out legal proceeding that ultimately, if this person is as you say he is, you can't win. you may get some inner satisfaction but at what price?
I dont mean to rain on your parade but these facts should be taken into consideration before going off half cocked.
The media,, with all due respect, can do very little to help victims get their goods or money back. All they can do is provide bad publicity for the trader and at best put that trader out of business but unfortunately that doesn't help the victims either.
Whatever course you take, I wish you luck with it and I hope you do get what you paid for or your money refunded but I wouldnt hold my breath if I were you.

Finally a post with commonsense advice. :2tsup:
If he is as clever as I think he is he would have conducted his business through various corporate structures and as such there would be no assets available.
If placed in liquidation the business would be quickly wound up as there would be no moneys to pay for a long investigation by the liquidator unless the creditors are willing to pay thousands more to finance the liquidation and then possibly to no effect. Hence this person would go scot free to start up again under a different business.
I would caution everyone as paying for a liquidator to investigate this would be very, very expensive. The irony will be that if, perchance, any criminal charges would be laid against him he would get legal aid whilst you guys would be paying for it.
Peter.

We finally got onto scott this morning after ringing about 7 times. We told him about the forum and all the heart ache he is causing which i am sure he is already well aware of .
He insists that due to all of the unhappy customers and media arriving on his door step it is stopping him from working thus meaning more delay's on the trailers. So basically if he is left alone to do his job he can get back to knocking up a trailer a day.
He said that he does not want to liquidate and that he wants to give every one their trailers . After all the lies this guy has told us we don`t know wether to believe or not . But what choice do we have ? we know he doesn`t have the money to refund ,probably only has the material to build ?
And by the looks of things some people are getting their:no: trailers , finally.
So what we are thinking is to leave him to do his job as it's the only real hope we have of getting our trailer's built.
Don't get me wrong we are angry and very, very worried but it's the only hope we have.

G'day All.
As most of the "Old Crew" know, I have been a member here for a few years.
I post to help others where I can. And also to learn from other members, more experienced that I.
I originally started this thread to see If I was the only "bunny" to be ripped off.
I never expected the response this thread has had, nor the number of people in the same boat as I.
I know that we (the ripped off) are frustrated as to what has happened.
I am also aware that the media is a hit & run ratings grabber. But sometimes it appears that ACA do, in fact get results every now & then.
I am also aware of the rules associated with posting to this forum. But I would like to ask the Moderators. Please don't lock this thread!.
There are a large number of people that have come together through this thread, all with a common goal, to either get what we have paid for or be refunded what we have already paid.
I know there are people that will say that this is not the place for it. But I put to these people... Where is the right place?
There are other forums out there that have similar threads to this one. But they have had nowhere near the response that this one has had.
So I put to you, The longtime members and moderators of this forum....What if you were one of the ripped off? Would you also be posting your thoughts and airing your frustrations here?
Now, I know that most of the posters to this thread have only joined this forum to post to this thread. But, how many of these posters actually have an interest in woodwork or other associated topics covered by this forum? Once this mess has been cleared up (one way or another) you may find that the people with the same grievance as I, will also become involved in the other topics covered on this site.
Hell, If we don't get our trailers, I'd say the Trailers thread under the Metalwork Sub-forums will get a hammering.:2tsup:
Yonnee, Dazzler, Etc Lookout....We are coming your way...:D
SO to finish up this epic (for me) post.
Please consider how you would feel in the same situation before considering locking this thread.
To the posters to this thread, Please keep it civil?
Thanks for your understanding.

Thats all very well, but seeing as you are a few hours closer to Melb than we are, why dont you go for a drive and meet the scumbag and really see him for what he is and will no doubt always be.
Im sure your views will change - DRAMATICALLY??
Go take a look at his workshop, where theres NOTHING and you may realize how shonky this character is.
I really feel for the peson I met their on Tuesday looking for his registered trailer with all his gear it, who left it there for minor zip repairs, who now doesnt have a trailer because Scott SOLD IT ON HIM. He was meant to go on holidays that day with his young family.
So think what you like and get told stuff that scott wants you to hear. The choice is yours
TRAILERS..... WOT TRAILERS..... AND WHO'S TRAILER WILL YOU REALLY GET.... MAYBE A STOLEN ONE PERHAPS ????

Hi all,
we spoke to Scott last saturday who indicated that he had considered closing the business down however after a discussion with someone ( not sure who) he felt that he could work his way out of the problems he has.
He stated that the media attention was not helping the situation - which to me make no sense because this has been going on for us since oct/nov last year. According to him he is planning on rectifying the problems and reimburseing us the money.........IN 6 - 8 WEEKS (excuse me if I am skeptical about this).
Personally I think its another croc of c$&p from him as we wont see a red cent. Anyway we are following through with solicitors, fair trading complaint has been listed and we will be contacting altona police as mentioned in other posts.
Has anyone had any good luck with their situation yet?

Some gov addresses will bounce redirected emails. If you send email through you ISP to another server the gov site might assume it is spam and block it. Send from your ISP direct to be sure that is not the problem.

Some gov addresses will bounce redirected emails. If you send email through you ISP to another server the gov site might assume it is spam and block it. Send from your ISP direct to be sure that is not the problem.
The email on this page (http://www.justice.vic.gov.au/wps/wcm/connect/DOJ+Internet/Home/Consumer+Protection/) is:

[email protected]. I am not sure what is going on with the addresses but the correct one appears to be the first.

We paid for our trailer in November 09. It was delivered soon after but had the wrong size tent on it. I informed Scott and he came and collected the trailer to fit the correct size tent (big mistake).
It has taken until now with many, many phone calls, delays, and lots of stress (as the rest of you all know about) but finally with much patience my trailer was delivered this past weekend.
Many times I thought I had done my dough but I hung in there because I had no other choice.
I do believe that Scott is doing his best to resolve the mess he has got himself into. I don't want to get into any chat over this. I just wanted to let you all know that there is hope for you. Good luck with it.

Thanks Rani for joining and seeing that you had some Goodluck.. I think that this forum has been quiet for a little to long and it is about time to get the ball to start rolling again..
So what is the Goss out there.. Is anyone else getting there trailers etc?????????
I dont believe that Scott is doing his Best to reslove the situation as he is still constantly lying to buy himself more and more time.. I know this from experience.
Rani you are one of the lucky ones as you only bought your trailer in Nov 09 and recieved it then returned it and got it back.. That was a miracle in itself..
I kinow you dont want to get into chat over this but I am just airing my opinion on your post.
I do hope and pray everyday that all the others will get there trailers or refund SOON.
People have been waiting since August 09 and still dont have there trailer so you are lucky and people have the right to be angry at that and to not give up as if we all do this, then he has just got away with complete Fraud on all accounts..
I know myself, i will not stop hassling him until he gives me what he owes us as it is righfully mine and he knows that..
I had the wrong tent on one of my trailers also but I am to scared to send it back as I know that I will never see it again as it will be sold to someone else.. It is a very viscious circle that he has created.
I hope there are some other Good stories out there that people have gotten theirs also..
Anyway Ciao for now..

We have made the offical complaint to the Victorian authourities only to be informed that there is nothing they can do to assist us as Scott has opted to continue to trade his way out of the mess he has created.
This of course is really frustrating for us seeing as we are the ones who have lost the money and havent received the goods yet this little imitation of a man continues.....how is this fair.:((
We have had several of "yeah mate i promise i will deposit the money into your account" (i am sure you all may have experienced these) only to our :o NOT surprise the money never arrives.
Next step is through the legal court system. We are at the point now that it has become a matter of principle than more about the money.......
We would love to hear from anyone who has had a miracle from the squid and got some satisfaction.

I thought l would give Scott a chance but no he has blown it. l have received legal advise and the next time we meet will be in court. Costs and time can be reduced if a class action is taken against him for fraud, ie: receiving monies without supplying the goods . Dont believe him at all when he says he has nothing, as he will be found out on his day of judgement.

Unfortunately, if you do get him to respond all he will do is feed you a sob story. Forget it and start legal action. This will take time and money so if serious enough grab more of "the conned" and all should support a class action. l believe he may be in Werribee, Vic, somewhere but not confirmed, ideally we need to know if someone has collected a trailer from any premises that he has operated out of and its whereabouts.:)

I would have to agree that people who have still not received their trailers at all or as promised would be best advised to take legal action ASAP. I cannot stress this enough . The only reason that this company is still in business is the fact that the proprietor has been successful in fobbing people off.
Make no mistake that the true underlying reason for the non delivery of goods in these cases is almost always due to financial difficulties or mismanagement by the business concerned. This means that if the company goes into liquidation today ( or if the proprietor is forced to file for bankruptcy) there will probably be not enough left to make restitution, after deducting the hefty liquidator fees.
The best chance of getting anything is by making the biggest noise, and legally there is no bigger noise than a writ issued by a court. You can do this yourselves by using the facilities of the Small Claims Tribunal, or by going to a solicitor. If you do the former, make sure you have a record of all the interactions with the company . Then as a precursor to issuing the writ through the Tribunal, send a written final demand for payment to be made within 7 days for the refund of all moneys paid, or legal action will be commenced without further action.
Any form of group action ( other than group legal action) may expose the dreadful business practices of this company, but it won't get your money back. It is too easy for shady operators that get "exposed" to simply close down and open somewhere else under another name with another shell company, leaving the former customers stranded. The only reason this guy hasn't paid is that he has felt less pressure to do so from you than he has from other customers. Its time to change all that.

Interesting reading these posts,
Hate to say I was a sucker for Scott and his camper on EBAY, Yes he is still selling them on ebay, we bought ours on 16 March and was finally delivered on 12 May...
He is trading as RIVERSIDE CAPMERS but no ABN number and his address is 54b Riverside Rd Werribee, and Mobile is 0412229373.
Our Problem started not long after we bough it, he had offered to put a new tent(bigger) we said why not, no extra charge, took it away the next day to supposably have the axle or elec brakes go and do a bearing. So was told will be fixed by easter, yea yeah no probs, well easter came and went and nothing was done, we were always told, cant get this, hold up with that, took it for a test drive and something else got problems.
Missus gets on the phone and rips him a new one. 2 days later the new trailer arrives....wasnt the old one fixed, this was a new replacement, so was happy bout that till i opened it up to find no kitchen , storage box, battery was there. So for the last month he had been promising to deliver but always problems and hassles, am supposed to register it tomoz at Vic Roads, and then head to Winton for V8's but waiting for him to come in the morning b4 i leave. Will be going to consumer affairs about this, by the looks, too many people have been affectd, and maybe even today tonight.
Will see what happens tomorrow if we get everything..
Will keep you posted.

Some of us have mentioned this before but it's worth reiterating again. The only way anyone will see anything from this shyster is by taking direct action, not by complaining to Today Tonight etc etc.
It will be a relatively simple case to take to the small Claims Tribunal (where lawyers are not allowed). In those places there are no excuses and the judge/adjudicators are no fools and do not suffer idiots like your vendor lightly. There is no escape from that and its decisive. The longer you leave it without any direct action, the more distant the prospect becomes of recovering everything.
You have to understand that these turkeys have hides thicker than a rhino and while we may think exposing them to public shame will make a difference it is actually meaningless to them. They may even get some perverse thrill out of it. Start the process and don't get sidetracked by any of the promises you may hear. The worst possible thing that could happen to the seller is for him to appear in the tribunal or in court, because he will be muzzled and absolutely no BS will be tolerated.
If you are not confident about taking the sort of action I was referring to, then get a friend or family member to help. Just do it and stay focussed on the task, you will not regret it.
BTW, without an ABN, its only a matter of time before the Australian Taxation Office catch up with him and they will not blink as they slap payment demands and or writs on him to recover unpaid GST and Income Tax and PAYG instalments. Just make sure you get in first!

Very interesting to hear that he is trading again and selling on EBAY, apparently he was banned from EBAY and just goes to show how easy it is dodgy businessmen to continue to trade unrestricted and free to rip off others. A number of us had made complaints to consumer affairs and the final reply we got was an email that they were concerned for any people with outstanding goods not supplied. I will certainly let them know he is trading again.
We were prepared in the end to get our trailer without the kitchen, just to get something for our money, but he was not interested and that was because he had sold our original trailer and promised others theirs who were also pushing hard. There was no chance I was going to get my trailer untill I camped out in front of his factory for a whole day and then in the end gave him 2 hours to get my trailer ready b4 I called the police.
Good luck

Its good to hear that people are still trying to get something out of this con man. I think if it takes people to camper at the front of his address so be it. Maybe if people did that at his living address then maybe their too could get there trailers or some money back. It is a shame that the law allows a guy like Scott to keep ripping hard working people off.

It saddens me to say it but i have become another victim of the shark that is Scott Mackinnon. I purchased a camper off him on ebay on the 19th of April and payed for the item that day via my bank Direct into Leah Mravleks account.. The alarm bells started to ring then. But it was too late I have had nothing but colourful Lies.
Even try the "I have turned a new leaf and instead of telling people what they want to hear ie "LIE" and then he lied again to my face. This Monkey has a big brass set and skin thicker than a rhino.
I went to his so-called workshop again today looking for the camper that i was promised and he was not there "suprise!!!"
He is not even answering my phone calls now.
I am now just filling out the small claims paperwork under the advise from my brother in-law who is a barrister.
Its just so frustrating that these types get away this.. The fact that he failed in one business making trailers and then opened up again down the road. Its just not right...

Hi, I sympathise with you and recommend that you proceed with Consumer Affairs Vic. There were many people who submitted complaints to Consumer Affairs and there was some group emails that went around then. When I read your posting, I forwarded this information to the contact I have at Consumer Affairs (to let him know that Scott is trading again). He is very interested to talk to you, which could fast track things for you. His name is Phil and he said to pass his phone number on to you - 03 8803 8453

We have contact CAV who were as helpful as T*TS on a bull...............they have stated that he is trying to trade his way out of the situation...........big whoopieeee.
We have recently received a call from some dude claiming to be from an accounting company who has been employed to assist the squid in dealing with all his financial issues......we were told to expect a letter from them .............that was 2 months ago.
After a follow up call this week....my husband has been told to contact the dude again and he will have a payment plan designed to get our money back.....
After all the dealings we have had with the squid, the crap and stories that us as with otheres have been told from him ............i am not holding our breath.

Does anyone know how many people the mackinnons owe goods to currently? I got caught up an a ebay saga with makita tools. To cut a long story short I traced an email he sent to me to an IP address at southernstar campers and here I am. After reading all the stories there is no doubt this is the same person including the phone number that has been posted on here previously, although it has now been switched off for a week. I have heard all the same excuses as you people have. As far as the tools go, I believe he sold more than $40000 worth that he sold as grahammac on ebay. I don't know how many people got caught up in that con as I can't find any forums relating to it yet.
